Practice Decision Request

Please place your practice question in writing using the criteria listed below. Forward your request to: Executive Director, Nevada State Board of Nursing, 6005 Plumas Street Suite 100, Reno NV 89519. Be sure to attach copies of nursing journal articles from your search. Your request will be placed on the next available agenda for the Nursing Practice Advisory Committee meeting. You are welcome and encouraged to participate in the committee process.

  1. State the practice question. Example: “Is it within the scope of practice for an (LPN, RN, APRN, CRNA, EMS-RN) to do . . .”
  2. How is this in the best interest of the consumer (the recipient of the nursing service)?
  3. Describe the current trends, standards (community, state, and national), nursing research, data and rationale that support this request.
  4. Describe the impact on the nurse.  Include how the scope of practice will be expanded and whether the practice would be considered independent, interdependent, or dependent.
  5. Describe your view of the overall economic and manpower impact this practice would have on the State of Nevada.  Include the impact on nurses, consumers, and the health care industry.
  6. Propose the standardized procedure of this practice.
  7. Describe and analyze the risks, benefits and alternatives.
  8. Describe the education components and/or requirements for initial and on-going competency.
  9. Describe the relationship of this practice to current and previous practice decisions, statutes, regulations, and advisory opinions.

Social Media Guidelines

The use of social media and other electronic communication is expanding exponentially as the number of social media outlets, platforms and applications available continue to increase. The very nature of this medium however can pose a risk as it offers instantaneous posting opportunities that allow little time for reflective thought and carries the added burden that what is posted on the Internet can be discovered by law even when it is long deleted.

Nursing Practice Advisory Committee

The purpose of this committee is to advise and report to the Board on matters related to the establishment of a scope of practice for nursing in this state. The committee consists of at least ten persons who are knowledgeable in all areas of nursing practice in Nevada and trends in national nursing practice.

Continuing Education

IMPORTANT UPDATE: During the 82nd legislative session (February-June 2023), the legislature enacted AB 267 which changes the requirements relating to the training in cultural competency. As you know, in 2021, the legislature enacted a mandatory requirement of 2 continuing education hours (CEUs) in cultural competency. AB 267 NOW REQUIRES THAT NURSES COMPLETE 4 HOURS OF CULTURAL COMPETENCY INSTEAD OF 2 HOURS EACH RENEWAL CYCLE.

What does this mean for you:

  1. As of January 1, 2024, when completing your license renewal, you will be asked if you have completed 4 hours of continuing education in cultural competency (NRS 632.343). The 4 hours of continuing education is part of the mandatory 30 hours already required by law (NRS 632.343).
  2. You must complete 4 hours of cultural competency continuing education each renewal cycle and those hours may be made up of as many Nevada Board of Nursing (NSBN) approved courses as you want so long as you meet the minimum of the 4-hour requirement.
  3. Should you be selected for a random audit, you will need to show proof of completion of all your continuing education.
  4. Should you be employed by a facility that has provided you with the cultural competency training required by NRS 449.103, and approved by the Nevada Board of Nursing, this training will count towards your cultural competency continuing education requirement.

Continuing Education/Training FAQs

How many CEs/CNA training hours are required for renewal?

RN/LPN

The Nevada Nurse Practice Act requires all renewing RNs and LPNs to complete 30 hours of nursing-related continuing education per renewal cycle. The Nurse Practice Act requires a 2-hour cultural competency course every renewal cycle. The Nurse Practice Act requires a one-time 4-hour bioterrorism course to be completed. 

According to NAC 632.343, licensees are exempt from the requirement to earn 30 CEs for renewal “for the first biennial period after graduation.” 

Therefore, new nurses who have earned their degrees within the last two years do not have to earn 30 CEs for their first renewal. However, they do need to complete the one-time, four-hour, bioterrorism CE Requirement and two-hour cultural competency course. The two-hour cultural competency course is required on every renewal. 

The Board encourages each licensee who treats or cares for persons who are more than 60 years of age to receive, as a portion of their continuing education, education in geriatrics and gerontology, including such topics as:

  1. The skills and knowledge that the licensee needs to address aging issues;
  2. Approaches to providing health care to older persons, including both didactic and clinical approaches;
  3. The biological, behavioral, social and emotional aspects of the aging process; and
  4. The importance of maintenance of function and independence for older persons.

CNA
The Nevada Nurse Practice Act requires all renewing CNAs to complete 24 hours of CNA-related continuing training within the certificate renewal period. CNAs must also have practiced as a CNA under the direction of a licensed nurse for a minimum of 40 hours per renewal cycle. While the legislature didn’t mandate the bioterrorism course for CNAs, the Board highly encourages them to take it as part of their 24-hour continuing education/training renewal requirement.

APRN
The Nevada Nurse Practice Act requires APRNs to take an additional 15 CEs directly related to their specialties to include a 2 hour suicide prevention course completed every 4 years, a 2 hour substance use and abuse course completed every renewal cycle, and maintain a portfolio pursuant to NAC 632.2563. CRNA
The Nevada Nurse Practice Act requires CRNAs to take an additional 15 hours of CEs related to the practice as a nurse anesthetist.

How do I submit my CEs/CNA training hours to the Board?

Rather than requiring licensees to submit their continuing education/training certificates at the time of renewal, the renewal application asks applicants to affirm (swear) they are in compliance with the continuing education/training requirement and reminds them to retain copies of their certificates in case of an audit. Then, the Board conducts random audits to ensure compliance. Failure to complete the continuing education within the renewal period, or failure to produce evidence of CE/training completion when audited, may result in disciplinary action. How long should I keep my CE certificates?

The Board recommends that you keep your annual CE certificates for at least four years and your bioterrorism certificate indefinitely in case of an audit.

What are approved continuing education/training providers?

If a continuing education provider is an academic institution, has a Nevada continuing education provider number, is approved by another state nursing board or health-related board (includes Boards of Medical Examiners, Pharmacy, and social workers), or is recognized by one of the organizations below, it is accepted by the Nevada State Board of Nursing.

  • American Association of Critical Care Nurses
  • American Association of Nurse Anesthetists
  • American Nurse Credentialing Center Commission on Accreditation
  • National Association of Pediatric Nurse Associates and Practitioners
  • National League for Nursing

What is the law for the mandatory Cultural Competency course? 

The course must include the all of the following components to be an approved course:  

(1) May include the training provided pursuant to NRS 449.103, where applicable. 
(2) Must be based upon a range of research from diverse sources. 
(3) Must address persons of different cultural backgrounds, including, without limitation: 
  

  1. Persons from various gender, racial and ethnic backgrounds;   
  2. Persons from various religious backgrounds;   
  3. Lesbian, gay, bisexual, transgender and questioning persons;     
  4. Children and senior citizens;   
  5. Veterans;     
  6. Persons with a mental illness; 
  7. Persons with an intellectual disability, developmental disability or physical disability; and 
  8. Persons who are part of any other population that a person licensed pursuant to this chapter may need to better understand, as determined by the Board. 

What is the law for the mandatory Bioterrorism course?

The course must include the following components to be an approved course:

  • An overview of acts of terrorism and weapons of mass destruction;
  • Personal protective equipment required for acts of terrorism;
  • Common symptoms and methods of treatment associated with exposure to, or injuries caused by, chemical, biological, radioactive and nuclear agents;
  • Syndromic surveillance and reporting procedures for acts of terrorism that involve biological agents; and
  • An overview of the information available on, and the use of, the Health Alert Network

What continuing education/training courses can I take?

  • Looking for a provider? Check with your human resources/staff development office, or try a web search, using key words like “Nurse (or CNA) continuing education.”
  • What kind of course can you take? A course which is designed to increase or improve a nurse’s or CNA’s knowledge, skill or ability related to the authorized scope of practice of the nurse or CNA (CNAs, please refer to the CNA Skills Guidelines).
  • Can’t find the classes the Board ordered you to take? Call the Board at 888-590-6726 and you will be directed to someone who can help you.

Please note: Make sure the continuing education/training provider is accepted by the Board.

How many CEs/CNA Training hours does a course equal?

  • 60 minutes of participation in nurse CE equals one contact hour
  • One hour of participation in CNA in-service training equals one contact hour
  • College credit (if taken as part of education program to obtain higher nursing degree; includes prerequisites) – one credit (semester) equals 15 contact hours, one credit (quarter) equals 10 contact hours

Board Information

Board Mission and Purpose | Nevada State Board of Nursing

What: The Board’s mission is to protect the public’s health, safety and welfare through effective nursing regulation. It is a government agency established by Nevada law to protect the public from unsafe practice by nurses.

Who: A seven-member board appointed by the Governor consisting of four registered nurses, one practical nurse, one certified nursing assistant and one consumer member. One member must represent the interests of those who are indigent, uninsured, or unable to afford health care. The Board is advised by and appoints members to six standing advisory committees. The Board appoints an executive director (a registered nurse) who is responsible for a staff of 27.

Why: In 1923, the state legislature established the Board to regulate the practice of nursing.

How: The scope of the Board’s original responsibilities has grown dramatically since 1923, when it licensed 104 registered nurses. In 2007, it is responsible for licensing, certifying and disciplining more than 33,000 individuals, including registered nurses, licensed practical nurses, advanced practice registered nurses, certified nursing assistants, and certified registered nurse anesthetists. The Board’s functions now include:

  • Establishing minimum practice standards
  • Approving schools of nursing and nursing assistant training programs
  • Adopting exams for licensing/certification
  • Licensing registered nurses and licensed practical nurses
  • Certifying advanced practitioners of nursing, certified registered nurse anesthetists, emergency medical   service/registered nurses, and certified nursing assistants
  • Developing and adopting regulations
  • Appointing advisory committees to get direct nursing input
  • Approving education/training programs for ongoing competency
  • Investigating complaints against nurses and nursing assistants
  • Conducting disciplinary proceedings
  • Administering alternative program for nurses and CNAs recovering from chemical dependency
  • Publishing, distributing and providing education on the Nurse Practice Act
  • Collaborating with consumers, individuals, groups and organizations
  • Providing education to increase public awareness and understanding of the Board’s role and purpose

The Board has authority only over its licensees and certificate holders and not over the facilities in which these individuals practice. The Board enforces the Nurse Practice Act (the law regulating nursing practice), with funding for all of its activities coming solely from the fees paid to the Board by licensees and certificate holders. The Board does not have authority to take action on issues that are of an employment nature or that relate to the profession of nursing as a whole. These matters are best dealt with by nursing associations, labor unions, or other similar entities.
